Deborah Higashi Dodge is an associate in the Boston office of Edwards Wildman. Deborah represents clients in a variety of civil litigation matters in Federal and State Court. Her practice focuses on patent, trademark, and commercial litigation. Deborah is also active in pro bono projects at the firm.
· Prosecuted criminal cases as a Special Assistant District Attorney for the Middlesex District Attorney's Office at Waltham District Court, including jury trials, bench trials and evidentiary motions.
· Advises a national office supply company with regard to issues involving claims of patent, trademark, trade dress and design patent infringement.
· Member of the litigation and appellate teams that prevailed in defeating on summary judgment all claims of design patent infringement against the Firm's client. The decision was affirmed per curiam by the Court of Appeals for the Federal Circuit.
· Defeated a motion for preliminary injunction and won summary judgment and dismissal of all claims of trademark infringement and unfair competition for a national pet supply retailer in Massachusetts Federal Court.
· Member of the litigation team that succeeded in invalidating a patent and obtaining an award of attorneys' fees, expenses and sanctions on behalf of the Firm's client after successfully defeating claims of trademark infringement on summary judgment in California Federal Court.
· Member of pro bono trial team that represented a Massachusetts Cemetery Association in lawsuit involving claims for misrepresentation and breach of the duty of good faith and fair dealing.
· Member of teams representing major pharmaceutical companies in patent infringement actions against generic drug manufacturers under the Hatch-Waxman Act.
