Erin Lyon is a Partner in our Birmingham office specializing in the defense of medical malpractice, products liability, and catastrophic injury cases. With over a decade of experience as an insurance claims professional and in clinical risk management at a leading academic medical center, Erin brings a unique and invaluable perspective to her legal practice. Having now returned to private practice, Erin represents physicians, dentists, nurses, and hospitals throughout the State of Alabama in medical negligence cases. She also regularly assists providers with Board investigations and other regulatory issues in front of numerous state regulatory bodies including the Alabama Board of Medical Examiners, the Alabama Board of Pharmacy, the Alabama Board of Nursing and the Alabama Board of Examiners in Counseling.
In addition to her work in medical malpractice, Erin also handles catastrophic injury and products liability cases. She regularly represents clients in commercial motor vehicle accidents, premises liability claims, and other types of bodily injury and litigation.
In addition to defending litigated cases, Erin continues to serve in an advisory, risk management, and/or general counsel role for a wide range of healthcare providers including dental practices and residential group home facilities.
Some of her recent representative experience includes:
•Managed a broad risk portfolio for an academic medical center of over 100 active matters across a wide variety of practice areas including pediatrics, emergency medicine, cardiology, and primary care (2018-23).
•Obtained summary judgment for an orthopedic surgeon in a case alleging improper performance and follow-up care associated with a total knee replacement, Tuscaloosa County Circuit Court. (2024).
•Took a leading role in expert and e-discovery issues in a catastrophic ten-fatality commercial transportation case where the firm was retained to assume the defense of the insured late in discovery, including resolving significant discovery issues involving the alleged spoliation of crucial telematics evidence (which her client was sanctioned for prior to her engagement in the case). She then helped lead a settlement team that was able to resolve the case for her client through multiple mediations and other settlement conferences, helping the client avoid potential bankruptcy. (2024).
•Represented a large international seat and restraint manufacturer in a products liability case with a quadriplegic plaintiff, including the development of alternative causation and damages theories that led to a favorable pro tanto settlement for her client, while the case proceeded to a 9-figure aberration verdict against the non-settling co-defendant. (2024).
•Obtained voluntary dismissal of a suit against a physical therapist alleging negligent care and treatment during therapy resulting in damaged post-surgical joint, Tuscaloosa County Circuit Court. (2024).
•Obtained voluntary dismissal of dentist in suit alleging negligent care and treatment of a same day denture patient, Tuscaloosa County Circuit Court. (2025).
•Obtained voluntary dismissal of CRNA in suit alleging negligent pre-surgical preparation of the eyes, Madison County Circuit Court. (2024).
•Assisted a clinic in an expansive administrative board investigation into the dispensation of controlled substances, managing the matter to a successful result. (2024).
•Assisted numerous medical and mental health professionals in compliance issues related to non-party subpoena requests across a wide spectrum of situations (2023-25).
Erin earned her Juris Doctor, with honors, from the Birmingham School of Law and her Bachelor of Science in Hospital Administration from the University of Alabama.
