CASE RESULTS: Construction Defect Lawsuit: Maryalyce Cox, Construction
Maryalyce Cox received a defense verdict in a construction case involving the design
construction of an upscale cigar bar in Montgomery County. The plaintiff was the owner of the bar
alleged the cigar humidor failed to maintain the desired humidity
temperature levels
later developed mold forcing the business to close down. Ms. Cox represented the general contractor. After 5 days of trial in 2017, the jury found that our client complied with his contract, did not breach any warranties,
was not negligent. The jury found DTPA violations
awarded damages of over $800,000 only against the engineer
architect, who settled pre-trial.

In January of 2019, Maryalyce Cox arbitrated a high damages case in which an employee sued her employer, a non-subscriber to Texas Worker's Compensation. Following the arbitration, the arbitrator ruled that that the employer did not violate any duty owed to the employee
awarded the employer a complete victory.

missing work for an injury that his co-workers
boss believed were not work-related. After a 5 day arbitration in 2017, the arbitrator ruled in favor of the restaurant, finding the employee's firing was not retaliation.
