You can include both the credit card and the lawsuit in the bankruptcy. However, you must include all your debts in the bankruptcy. Also, credit charge purchases made before filing bankruptcy can be excluded.

I would strongly suggest you go back to your bankruptcy attorney and determine what the actual status is. Otherwise, engaging new attorney and have the discharge reviewed to determine whether or not a mortgage note was included in the discharge. Given a choice between the advice of someone over the phone from the mortgage company and that of your attorney, I would tend to believe your attorney first.

In Idaho, they take the amount of days before your bankruptcy for the year and that is the proportion of the income tax refund that is part of the bankruptcy estate. The overall refund is divided according to that percentage. Of course, the total amount is reduced by any exempt portions of the tax refund.
