If you only have medical debt you would want to file a Chapter 7. However, you don't get to choose. Whether you qualify for a Chapter 7 is determined by income under the "Means Test." If you make too much money under the Means Test then you would have to file a Chapter 13, where you make monthly payment for 5 years before you get a discharge, and which is much more expensive to file.

Question Detail: After filing for bankruptcy in the state of Kentucky, I was involved in a situation where I filed a lawsuit against another party (cause of action was 7 months after filing for Ch. 13 bankruptcy). With 1 year left in my bankruptcy plan, the lawsuit settled out of court. Is the settlement part of the bankruptcy estate, or is it mine since it happened after the bankruptcy filing? *- YES, absolutely it is part of the bankruptcy estate, but to what extent depends on the nature of the claim and the characterization of the settlement proceeds. *
