You must list all of the debt you owe. You are not permitted to exclude any debts. With regards to the scam debts, since you did commit any fraudulent act the debt should be dischargeable.

Can we still sell our home before the sheriff's sale?

Bankruptcy doesn't affect your right to redemption under state law. But it's very difficult to sell a house that is in a foreclosure, most buyers will shy away from it.

Should I file for bankruptcy if I cannot pay attorney fees? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
If you had been drinking, you cannot discharge damages for personal injury. Ordinarily you can discharge legal fees, but there are exceptions. It is perfectly lawful to represent yourself in a bankruptcy, but it is rarely a good idea. It's almost always best to retain an experienced lawyer. Some lawyers will accept instrumental payments. Good Luck.
