I suggest that you see an attorney, and must assume that that you are asking whether or not you will be able to continue your tenancy with your current landlord if you are behind and seek to discharge the past due rent is part of a bankruptcy proceeding. It is difficult to answer the question without the specifics but you may be absolutely assured that if you do not pay your rent timely following the filing of a bankruptcy you will be evicted.

Whether you should file for divorce or Bankruptcy relief first ultimately depends on the specifics of your case, the nature of the debt being discharged, the assets accumulated during the marriage, etc... For that reason, it is near impossible for me to recommend either one without knowing all the facts; however, I can say that a family law court will not entertain settlement discussions in a divorce case if one or both parties have a pending Bankruptcy Petition. The family matter is typically "stayed" until the Bankruptcy discharge because Federal Bankruptcy Court takes precedence over State Superior Court. For that reason, I typically recommend that the Bankruptcy take place first so it doesn't get in the way of the divorce matter proceeding as scheduled and it also discharges debt that would otherwise have to be negotiated in the divorce matter. Regardless of whether you file Bankruptcy first or Divorce first, you are not supposed to do both at the same time. Hope that helps.

Question: If I easily qualify for Chapter 7 based on income guidelines, can they force me to do Chapter 13? Question Detail: My yearly income is about $15,000. I'm way below the median family income for my state, which is about $38,000. I have some expenses (about $800 per month) that they might not consider as being necessary (trust me, there's not many things they consider as a necessary expense) and thus they would conclude I have disposable income, which is probably true. I am not legally required to pay that $800 out as I do. Can they force me to do a Chapter 13 instead of a Chapter 7 on that basis alone? I am trying to settle my most recently used cards but the ones that I used before I stopped paying on my debts I feel like I used them in good faith with every intention of paying them off. I ended up with more than I could handle. *- having gross monthly income below the median is only PART of the MEANS TEST; having disposable monthly income over $100 will also put you in a Chapter 13. HOWEVER: depending on your particular circumstances, you may very well not meet the standards necessary to support a confirmable plan. You should consult with a lawyer to discuss the particulars of your case. *
