Will we lose our car in a chapter 7 bankruptcy?

default-avatar
Answered by attorney William Monroe Rubendall (Unclaimed Profile)
Bankruptcy lawyer at William Rubendall Attorney at Law
Proving that you have made all the payments should help you establish real ownership. If the car is not paid for your husband's credit will be affected and he can be sued by the lender. It depends on how the bankruptcy schedule B describes this asset. Also, it depends on how the exemption is claimed in Schedule C. Your parents' bankruptcy attorney should be able to explain those things to you.

Would we lose all of these things when we file for bankruptcy?

default-avatar
Answered by attorney Raymond Hillel Aver (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Raymond H. Aver, A Professional Corporation
It is difficult to answer your question without more information. However, you should not lose anything by filing bankruptcy depending upon your circumstances and what chapter of the Bankruptcy Code you decide to proceed under. You should certainly consult with a bankruptcy attorney before filing bankruptcy. You should be familiar with the value of your residence, and how much is owing to the lender(s) holding a deed of trust against your residence. It would also be helpful to know how much in property taxes you owe. Similarly, you should be familiar with how much is owing to the lender(s) against your automobile.

What is your advice if I am way over my head in debt?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
Obviously a bankruptcy is definitely worth considering. I would suggest that you limit the size of the withdrawal from your 401(k) to enough to (a) meet your immediate needs for just a few months until you can reasonably expect to find a new job; and (b) pay the costs and fees of a bankruptcy. The filing fee for a Chapter 7 is $335; for a Ch. 13, $310. Lawyers will ask for an advance payment ('retainer') in an amount they will estimate based on how much work the filing apparently will require. In my office, we usually ask for a retainer of $2,000 for a Ch. 7; and $2,500 to $3,000 for a Chapter 13. It's not really cheap, but it can be a lifesaver for people who really need it.
