How do I or where do I list the co-signed loan for a friend to get a house in my chapter 7 bankruptcy?

Ralph Lynn Williams
Answered by attorney Ralph Lynn Williams (Unclaimed Profile)

You need to pull a copy of your credit report, go to annualcreditreport.com to obtain one. The loan should be listed on your credit report. If it is not included in your credit report then use the last known lender and address. If the loan was secured by real property the debt would be listed on Schedule D as a secured debt and if it was not secured the debt would be listed as an unsecured debt on Schedule F. You should also determine if you were on the property title as having an interest in the property and has the property been foreclosed on.

Can I roll over my American Airlines pension to an IRA?

Helene Thaissa Wasynchuk
Answered by attorney Helene Thaissa Wasynchuk (Unclaimed Profile)
Bankruptcy lawyer at The Bergman Law Firm
Don't even think about that unless you put it somewhere where the funds are safe, and you can never take them out and use for living expenses. Everyone that I know that has taken out their pension and thinks they can do better with the money lose all of it. Putting the funds into some type of irrevocable trust is the only recommendation that I would give you.  Protected from you, your creditors and anyone else who might see you as a target. As in a new spouse.

Should I file for bankruptcy if I am back on a loan?

Jeffrey David Solomon
Answered by attorney Jeffrey David Solomon (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Jeffrey Solomon
Did you add your parents as a lienholder on the title certificate through the state of Florida? If not, there is no valid lien on the title. The trustee would claim the car is owned free and clear. And changing the title now would have its own problems. You should consult an attorney.
