If sheriffs gives me a 5 day notice can I file for emergency bankruptcy?

Answered by attorney Edward M Olson (Unclaimed Profile)

If you are just looking for 15 days delay, then filing bankruptcy is a terrible idea. Between the work involved in preparing the schedules, taking the pre-filing course, paying the filing fees.. you will save a lot of money by finding temporary housing for 15 days somewhere else.

Is there any possible way to keep a car when filing a chapter 7?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Questions about keeping a car are the most common concerns that people have when considering bankruptcy. Cars that are financed are seldom at risk of being taken away by the bankruptcy process (unless the equity in the vehicle is very large), but the car can be repoed by the finance company if you don't make the payment and if you don't reaffirm the vehicle loan. In Nevada, your vehicle would need to have equity of more then $15K to be at risk.

Can I be sued from a landlord while going through a chapter 7 bankruptcy?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Pho Ethan Tran, PLLC
During the pendency of your chapter 7 bankruptcy, no creditor is allowed to take collection actions against you unless the creditor requests and is granted a lift of the automatic stay by the court. Did you list your landlord in the petition so that he had notice of the case.
