Should I continue to pay on bankrupted property four years after discharge?

Answered by attorney Ronald Karl Nims (Unclaimed Profile)

Assuming that you didn't reaffirm the mortgage, you can stop paying on it at any time but you'll lose the house. As long as there is a balance due on the mortgage, the lender can foreclose.

Can the trustee take 100% of the proceeds if the business owner wins the tax lawsuit?

Answered by attorney Marjorie A. Guymon
Bankruptcy lawyer at Goldsmith & Guymon, P.C.
If it was an llc that filed bankruptcy, there is no discharge. The case most likely remained open to see what, if anything, would happen with the lawsuit. If the suit results in payout to the llc then the proceeds belong to the bankruptcy estate. The trustee will take his/her % recovery and disburse the rest to the creditors pro rata. The trustee is required to pay any taxes incurred during the bk case.

Am I responsible for that debt even after the discharge?

The fees that were owed on the date you filed bankruptcy have been discharged however, any fees since the bankruptcy are your obligation. Generally, homeowners associations secure their fees by putting a lien against the property, not suing the owner.
