Can the bank change the terms?

Answered by attorney Rustin Scott Polk (Unclaimed Profile)
Bankruptcy lawyer at Polk & Associates
The rules about reaffirming a HOUSE are totally different from the reaffirmation rules relating to a CAR. So don't read on the internet a comment saying they could take the car, and then think that means they could take your house. Instead, take a look at the section of the bankruptcy code that governs reaffirmation. You'll see in there that reaffirmation agreements are for PERSONAL property (like cars, furniture or jewelry). Your house is not personal property, it's REAL property. Completely different animal.

Can bankruptcy end a civil debt?

Generally, yes, those debts will be discharged as part of the bankruptcy. However, if the underlying judgment found that there was some type of fraud or other instances, the debt may not be discharged. Visit with your attorney to make sure.

How many years does a bankrupcy stay on my credit report?

Scott Russell Needleman

Bankruptcy lawyer at The Needleman Law Office
It stays on your credit report for 10 years. You can apply for a home loan whenever you want after discharge. If you have a lender, even before discharge.
