Which bankruptcy do I need to file to help me with my mortgage?

It depends on the amount of your debt, but either chapter 13 or chapter 11. Chapter 13 if your non contingent, liquidated unsecured debt is less than $250,000.00 and your non contingent, liquidated debt secured debt is less than $750,000.00.

How do I get a bankruptcy off of my credit report?

default-avatar
Answered by attorney Sanaz Sarah Bereliani (Unclaimed Profile)
Bankruptcy lawyer at Bereliani Law Firm, PC
Unfortunately you cannot get the bankruptcy information off of your credit report and it will be there for 10 years. After you finished your bankruptcy your attorney (if you had one) should've informed you of how to rebuild your credit. Most mortgage companies these days are willing to work with people on new mortgages 2-3 years after bankruptcy. It sounds like you want to get an unsecured loan to get the property, however, maybe you'll have a better chance at a mortgage as it'll be secured by the new home. I would have an attorney that handles bankruptcy and credit repair to review your credit report and see how they can help you rebuild your credit or get new loans.

Can I legally have bankruptcy from my credit report early?

Answered by attorney Kathryn Ursula Tokarska (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Kathryn Tokarska
A Bankruptcy will stay on the credit report for 10 years. I don't know of any way to make it go away sooner. However, the impact of the bankruptcy on your credit score will lessen with time. Many lenders are willing to give prospective home borrower a mortgage loan, provided of course they qualify in other respects, 3 years after bankruptcy. Some lenders may even do it sooner if there were extenuating circumstances that lead to the bankruptcy, for example: large medical debts.
