Don't take legal advice from your creditors.   That's rule #1.   If you file a bankruptcy case and receive a discharge, the discharge will include all debts that you owed on the date your bankruptcy case is filed.  So, if you incurred the debt you mentioned in May 2013 and file your Chapter 13 after that, the debt should be discharged unless it falls into one of the types of debts excepted from discharge. These exceptions include debts incurred through fraud, domestic support obligations, certain taxes and others.   As a final thought, if your lawyer is too busy to answer your questions, you may have picked the wrong attorney. In the District of Kansas you can pay the Court's Reopen fee of $260 and file a Motion to Reopen your case and file the appropriate certificate(s). If you have an attorney, which it sounds like would be helpful, they would likely charge attorneys fees for this, but ensure that it is done correctly.

If you are unhappy with your lawyer and not communicating, it is time to get a new one. Make sure, however that the problem is not your unrealistic expectations. Changing lawyers in the middle of a case is time consuming and difficult. It is better to do so before the ? 341 hearing than after. Positions can get set and impressions made that are difficult if not impossible to correct later.
