What type of bankruptcy or other legal action might be best for my situation?

David Lawrence Pritchard
Answered by attorney David Lawrence Pritchard (Unclaimed Profile)

Generally which bankruptcy depends on your overall situation. However, most people in this situation want to file a chapter 7 bankruptcy.  However, without a understanding of your over all situation it is impossible to give good advice.  You really need to visit with a bankruptcy attorney in your area.   If you provide me information on where you live, I can try to recommend someone. Can the bank change the terms?

Susan Green Taylor
Answered by attorney Susan Green Taylor (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Susan G. Taylor
I've never heard of a mortgagee retaliating that way for failure to execute a reaffirmation agreement in a chapter 7 bankruptcy. The worst I've heard is one refusing to report your payments to a credit bureau.

How many years does a bankrupcy stay on my credit report?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
10 years, but most creditors will work with you on a new home loan within 4-5 years of filing your bankruptcy. That assumes you rebuilt your credit during that 4-5 years.
