Can my friend get sued for a loan I repaid her?

William H Nebeker
Answered by attorney William H Nebeker (Unclaimed Profile)
Bankruptcy lawyer at Havens Law, LLC
The trustee can recover the money because it is a preferential transfer. The bankruptcy code does not look at intent when there is a preference. Since she got more than she would have in the bankruptcy the trustee can sue to recover the funds. You can try to work out an agreement with the trustee for a lesser amount. You should contact a bankruptcy attorney to help you through this.

You should research the debt. You may have grounds to file a Motion to vacate the judgment. Also, you may want to consult with a bankruptcy attorney.

What will happen if I filed bankruptcy and before it was discharged I got a car I really needed and I can no longer afford the car?

If the car was purchased after you filed then it was not covered. If it was purchased before filing it probably was but it's tough to be sure without seeing your file.
