What can I do about the bank holding my unemployment benefits to payoff legal fees and satisfy a judgment?

default-avatar
Answered by attorney Austin M Hirschhorn (Unclaimed Profile)
Bankruptcy lawyer at Austin Hirschhorn, P.C.
If you deposited your unemployment benefits into a bank account in your name and the bank was served with a garnishment by a creditor they would have to place a hold on the money in your account and apply it to the garnishment. You should receive a copy of the disclosure filed by the bank which would give you the opportunity to challenge the garnishment if you have a defense. If there were legal fees involved in the judgment they would probably be included in the balance showed as owing on the garnishment.

How does his bankruptcy default going to affect me?

Yes, it will. You should have checked that he was paying and could have gone to court to ask the court to compel him to pay. Now you can go to court to compel him to pay the creditors if they come after you. However, you have to act as soon as a credit contacts you and not wait.

What should I do with the unpaid water bill from the previous owner of my property?

Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
This is why you need an attorney with you at the closing. The bill is now yours (and it is a lien against the house, so you better pay it). You can sue the former owner in small claims court... but only if your purchase agreement required the former owner to pay the bill.
