What are the landlord rights with a tenant who files bankruptcy?

Answered by attorney Mitchell Reed Sussman
Bankruptcy lawyer at Sussman Associates
The tenant is essentially correct. You can not force the tenant to pay back rent, but if the tenant remains in possession you can sue for post BK rent.

Is a debtor legally obligated to pay an unsecured, pre-petition, credit card debt?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Are you asking if a debtor is required to pay unsecured debt after they filed a bankruptcy case?  The answer to that is no, if they received a discharge.  I suspect there are too many facts missing here to answer the question you meant to ask. In a Chapter 13 bankruptcy case, some percentage of unsecured debt may be paid pursuant to the plan that is proposed, but I'm not sure if that's what you meant either. Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.

When can you file chapter 7 bankruptcy after filing chapter 13 bankruptcy?

Answered by attorney Stuart Jon Bierman (Unclaimed Profile)
Bankruptcy lawyer at The Law Offices of Stuart Jon Bierman
The time period may vary because different states may have different Local Rules so you should ask a lawyer in your state. If you are in a situation where you have filed for chapter 13 but are having difficult making the monthly payments and are trying to find out about converting from a Chapter 13 to a Chapter 7: I think the answer is that you can do so anytime.
