Can you borrow money while still under chapter 13?

Charles J Schneider
Answered by attorney Charles J Schneider (Unclaimed Profile)

Depends on your confirmation order regarding the incurrence of a debt. The Trustee would find out because you are a law abiding citizen and would tell him voluntarily if required by the order to do so.

Should I appeal a bankruptcy court decision even though I own a small business?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
You need to consult with a bankrupty attorney in your area.  There's too much missing information to answer your questions. First of all, Trustees don't "order" anything.  They do not have that power.  If you filed a Chapter 7 case, the Trustee can sell the assets of your business if their value is beyond the exemptions that you took.  If this is a Chapter 13 or Chapter 11, you would have to pay your creditors at least as much as they would get in a Chapter 7. Since you say the Trustee ordered this, there would be nothing to appeal, since you can only appeal a court order.

Can the bankruptcy courts take my inheritance in a chapter 13 bankruptcy?

Yes you must disclose the inheritance BUT it is not income and the trustee is NOT entitled to it. HOWEVER you should engage an attorney familiar with local practice to guide you.
