You might have been able to stop the garnishment during the period of the automatic stay. But, if the debt is a priority debt it will go through bankruptcy unaffected, & you might not thereafter be able to stop garnishment.

She must list all of her assets when she files bankruptcy. She does not have a choice about that. But she does not have to "turn it in," you also own it. She does not have to turn her car in either. It depends upon which chapter she files under, 7 or 13, as they are vastly different. If she files a chapter 7, the trustee may contact you and want you to purchase her interest in the vehicle, do not offer much.

It's not that they are trying to penalize you but filing bankruptcy does affect your credit history and credit reputation. Most, if not all, banks require that you wait 2-3 years from when you filed bankruptcy or had your foreclosure/shortsale/etc in order to get a new mortgage in order to rebuild your credit. They are not trying to penalize you and there is nothing they needed to do during your bankruptcy.
