What happens to my rent to own home with $15,000 down payment if I file for Chapter 13?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
Read the contract. It is probably forefieted if you file bankruptcy. On the other hand it may not affect the situation at all. You will have to pay attention to the things you sign from here on. You have to keep up the payments if you expect to buy the home.

I have sold my house and I will have $49,000 in equity will the trustee of my Chapter 13 take this equity to pay debts?

Did you claim it as exempt on Schedule C of your petition? If so, the Trustee cannot take it, if not, the Trustee can take this money.

How do I file exemption for the money that was garnished?

John A Moffa
Answered by attorney John A Moffa (Unclaimed Profile)
Bankruptcy lawyer at Moffa & Breuer, PLLC
The question is not clear. If there is a garnishment proceeding, you SHOULD have an opportunity to claim any exemption to which you may be entitled in that proceeding and you should have your attorney request a hearing on your claimed exemption.
