There is no easy answer to this question. Depending on the size of the refund and the source of the refund, for example, if the refund is due to earned income credit or is relatively modest, say under $1,200, it may be possible to file bankruptcy right away & still keep the entire refund. You would need to review all the exemptions available to you to help you figure out the answer.

There are several reasons, both legal and practical, for you to file your bankruptcy prior to marriage. The legal reason is that on both your Means Test (the eligibility test for Chapter 7) and your actual bankruptcy budget you must include a spouse's entire income, whereas you only have to include that portion of a boyfriend's income that is actually used to pay your household expenses. In short, it is much easier to prepare and deal with the Means Test and the household budget when you are not married. The practical reason is that, while your husband will not be liable for your debts just because he is married to you, things can get a bit complicated if you and he have joint assets and a creditor obtains a judgment against you and attempts to seize those joint assets. The creditor may not be able to do this in many instances, but a young marriage could probably do without such complications.
