It takes me about a month to get all the paperwork ready to file with the bankruptcy court. If you can file an "emergency bankruptcy" and you think that will enable you more time to relocate, then go ahead and do it. An automatic stay pursuant to federal law will be in effect on the moment you file a bankruptcy. This means that no creditor can proceed with an action in State court. The sheriff has already given you a 5 day notice. But I do not know what the notice says. If it says you have 5 days to vacate, then you should vacate. Filing bankruptcy is not something you can just go an do so that you have more time to move. It is a very serious decision for which you need competent legal advice. The law changed back in 2005 so that people who are going to file bankruptcy must first go over their financial circumstances with an approved consumer credit counseling agency, and get a certificate saying that they have done so.

Once a creditor obtains a judgment, they can utilize the services of local law enforcement to take money & property from you by wage garnishment, bank account attachment, liening any real estate you own, and taking property not protected under state laws called exemptions. If you can qualify to file bankruptcy, you can eliminate this debt in bankruptcy, but if the creditor has recorded a lien on any of your real estate, a supplemental proceeding will be necessary to remove that lien. As you are finding out, the divorce court can say one thing, but if the person you married is irresponsible, you can be stuck holding the bag. IMHO, anyone thinking about getting married ought to think twice and have an investigator check out the financial background of the intended.

Lien holder. As long as your Chapter 13 plan conforms to the bankruptcy law, then the lien holder is forced to comply with the terms of he plan. The lien holder can't bring suit against your cosigner because bankruptcy law prohibits suits against cosigners during the plan. When your plan is complete, the loan will be paid off or (it's is a long term loan like a mortgage), the bankruptcy court will issue a court order stating that the loan is current and the lien holder has no right to sue on a current loan. If the lien holder fails to file a proof of claim with the court, you, as the debtor, can file a proof of claim and the loan will be handled based on the information in your proof of claim?
