You can file Chapter 7, when your six month average goes below the county median income level. So, two months of zero is bringing your average down. You can go back to work, after you file, however, unless unforeseen high wage income, is actually foreseen (waiting in the wings). this must be declared to the bankruptcy court. Outta of the house? After the bankruptcy is discharged, or relief from the stay, the creditor still has to go through the foreclosure process. I have clients in homes one to five years after their bankruptcy was discharged still. Amazing...

Is the attorney allowed to resent the judgement when it was dismissed fully in bankruptcy and he was given proper notice?

The bankruptcy discharge eliminated the liability on the car accident. That is why you were able to get your license back. Based on your information, the attorney should not have resent the notice to DMV to have your license again suspended. I am assuming the attorney was on notice of the bankruptcy. You should immediately inform the attorney of his error and demand that he immediately notify DMV of his mistaken letter so you can get your license reinstated. You may be able to ask the bankruptcy court to reopen the case to impose sanctions on the attorney and his client.
