Chapter 13 Trustees do not seek to sell property.  I think you mean the Chapter 7 Trustee is trying to do that.  You need to hire an attorney who can review all the relevant documents, including the opposition that was filed, and assist you to the extent possible with converting to Chapter 13.

If you are in a C13, your budget is filed with the Court (Schedule J) and you should stick to it. What happened? If there are certain expenses not lsited, file an amendment and get a lower trustee payment so you can make the post petition payments on those items.

There is an 8 years waiting period between the time you can file Chapter 7 cases. If you filed a Chapter 7 in 2007, you would not be able to get a discharge in another Chapter 7 until 2015. The waiting period starts from the time the prior case was filed.
