I stand to inherit from my parent’s estate. Will this affect my Ch. 13?

Chapter 13 Trustees require that you file an annual update during the life of your Plan. If your income goes way up or you pick up a bunch of property free and clear, it would need be reported. If you are in a 100% Plan, you can pay it off early. If you are not in a 100%, the Trustee may require you to pay in a minimum of 36 months or 60 months, based on whether your income is over the CMI test or not.

What can I do if my ex husband is filing bankruptcy before my name is removed from the mortgage?

Answered by attorney Alan Emmerson Ramos (Unclaimed Profile)
Bankruptcy lawyer at Alan E. Ramos Law Offices
The only way that your name will be removed from the mortgage is if the property is sold or refinanced. Your agreement with your soon to be ex-spouse will not remove your legal obligation for the mortgage.

My wife co-signed for her mother on a bank credit card. Now married, my mother is filing bankruptcy. Will my wife be paying?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
Most probably the bank will come after your wife. Call, and confirm in writing, that you wish to withdraw from any father guarantees. They will most probably cut off the credit card. That should stop the loss. Then you can go to the bank and seek to cut a deal. Generally your wife is liable for the full amount legally although there may be exceptions, see a lawyer.
