How long does it take to file bankruptcy in order to stop a foreclosure sale?

Answered by attorney Michael Jay Berger
Bankruptcy lawyer at Law Offices of Michael Jay Berger
I can file an emergency bankruptcy petition in one day in order to stop a foreclosure sale. It is necessary that the individual debtor(s) take a consumer credit counseling class online first, pay me, and give me the information that I need. The balance of the bankruptcy schedules can be completed within 14 days of the filing of the bankruptcy petition. In cases of extreme urgency, I am able to file bankruptcy the same day that I am hired, even if that day is the day of the foreclosure sale. To stop a sale, the bankruptcy filing must happened BEFORE the sale and we must notify the company that is conducting the foreclosure sale. It is not too late.

What is the remedy if the lien holder won’t release title so I can register the car?

Bankruptcy lawyer at A Fresh Start
What you have not told me is whether the lien on the vehicle has been paid off. Whoever told you that you needed the lien to be released in order to register the vehicle is wrong. You simply need a certificate from the lien holder showing that you are the registered owner. Your bankruptcy will not remove a valid lien from a car. The only way to do that is to pay off the lien holder.

The best thing to do is go to annualcreditreport.com and you can pull a free credit report from all 3 bureaus once a year. There is no debt minimum or maximum to file.
