What will happen to our trust if we file for bankruptcy? How?

Quite often, the Trustee in a Ch. 13 is interested only in the income which reaches you from the Trust, not your ownership interest in the Trust itself. She or he will no doubt want to see the trust document. Consult an experienced BR lawyer in your area. It's almost always worth the investment.

What can be done to a case filed under an incorrect name?

I am confused. If the real debtor was in court the judgment should be good. The Jr has a right to ask you have your judgment against his father corrected. I would cooperate.

Is it OK to have all my bills go to a PO box even if I'm living in the same house and do I write to creditors asking to be contacted by mail only?

Michael C Hyde
Answered by attorney Michael C Hyde (Unclaimed Profile)
Bankruptcy lawyer at Office of Michael Hyde PLLC
You may inform your creditors to contact you by mail. If you open a PO Box, you should inform your creditors of your new address. Also, the post office will keep forwarding and mail addressed to your home address to the post office box number for about 90 to 180 days before the forwarding order expires.
