There is a section in the bankruptcy petition that asks about recent payments to creditors. You should consult with an attorney regarding the specific consequences of paying off any one creditor prior to filing.

Can I file bankruptcy if I cannot afford my mortgage or bills?

default-avatar
Answered by attorney Tony E. Carballo (Unclaimed Profile)
Bankruptcy lawyer at Carballo Law Offices
A mortgage is a secured debt so while you can stop the sale by filing a bankruptcy case the bank will seek permission from the bankruptcy court within a few months to foreclose unless you pay the back payments as part of a Chapter 13 plan of up to 5 years and future regular payments after filing for bankruptcy. You should run to the office of a local bankruptcy lawyer for advice on your options before it is too late. You must have adequate income to propose a Chapter 13 plan. Maybe you can rent the house and live in a trailer so you can have enough income.

Do you have to be a citizen to file bankruptcy?

default-avatar
Answered by attorney John Frederick Leaberry (Unclaimed Profile)
Bankruptcy lawyer at Law Office of John Leaberry
You can file bankruptcy if you meet the eligibility requirements for the Chapter you wish to file. Being a citizen is NOT a requirement. Immigration status is not affected by bankruptcy unless fraud or moral turpitude is involved. If citizenship is your objective, bankruptcy won't negatively affect your application.
