What exactly is the customer claim form for Energy Future Holdings bankruptcy and how do I fill it out?

default-avatar
Answered by attorney Rustin Scott Polk (Unclaimed Profile)
Bankruptcy lawyer at Polk & Associates
If Energy Future Holdings owes you money for something, then you use the Proof of Claim form to tell the bankruptcy court how much the company owes you. Then someday if there is money left over to pay claims with, you may get a portion of what Energy Future Holdings owes you. If they don't owe you any money at this point, then you are free to ignore the claim form that you received.

Is it too early to refinance or do we have to wait for the 10 year period?

Giovanni Orantes
Answered by attorney Giovanni Orantes (Unclaimed Profile)
Bankruptcy lawyer at Orantes Law Firm
There is nothing to prevent you from applying to refinance. You should try to refinance with all lenders, not only the same one already holding the first loan. Whether you get the refinancing will depend on how well you have re-built your credit in the four years after your bankruptcy discharge.

Can my daughter file bankruptcy with her loans?

Answered by attorney Steven Jed Alpers (Unclaimed Profile)

You cannot file bankruptcy on most student loans and if you are co-signer you will be responsible for these debts. Also, the lenders are probably reporting the non-payments on your credit reports so you should help as much as possible to protect your credit
