Could I file chapter 7 to get an eviction to stop in a small business?

Giovanni Orantes
Answered by attorney Giovanni Orantes (Unclaimed Profile)
Bankruptcy lawyer at Orantes Law Firm
Yes, but you may lose the business anyway if a Chapter 7 trustee feels the business is valuable, for example. Note that it may be possible to recover the lease if you file before you are actually evicted that is, while you are still in possession. If the business is not held by a business entity, such as a corporation or an LLC, a Chapter 13 case may accomplish your goals. Otherwise, a Chapter 11 attorney may be required. You need to consult an expert in this field to assess your options.
