Are 1099Cs dischargable?

default-avatar
Answered by attorney Tony E. Carballo (Unclaimed Profile)
Bankruptcy lawyer at Carballo Law Offices
A 1099C is a tax liability issue and not a debt that is dischargeable in bankruptcy but bankruptcy may eliminate the tax liability if the debt was discharged.

2013 C7, had 1st & 2nd mtg w/same lender. I mod the 1st only & cont to pay. Never heard from the 2nd mortgage.

Gerald Lewis White
Answered by attorney Gerald Lewis White (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Gerald L. White
Your personal obligation to pay the 2nd was discharged but it remains a lien against the property and can be foreclosed upon.  I see this happen when the lender thinks that there is enough equity to make it worhwhile.  The equity grows when the property appreciates in value over time or you pay down the balance of the 1st.  You should explore whether you are eligible to get a new 1st to pay off the balance of the 1st and 2nd.  Otherwise, if you contact the 2nd and alert them to the fact that there may be enough equity to foreclose, they may decide to do so and, if you can't refinance, you may need to sell the property.

Can the debtor file a motion to dismiss in bankruptcy?

Answered by attorney Nicholas Belisle Lazzarini
Bankruptcy lawyer at Young & Lazzarini
If the case originated as a voluntarily petition, the debtor always has a right to file a motion to dismiss the bankruptcy case. However, the motion may be opposed by creditors who feel they are more likely to be repaid should the case continue. A hearing on a motion to dismiss must be noticed to all creditors and parties. You should be aware that, even if dismissed, the bankruptcy filing will show on your credit report, though any debts listed on the petition will not show as discharged which will help your credit rating. Also, you may face some obstacles should you change your mind and decide to go through with a bankruptcy in the next several years. You should consult an attorney to determine the best course of action.
