If we did not reaffirm on mortgage after filing Chapter 7 Bankruptcy, can we walk away from the mortgage? How?

Sally J Elkington
Answered by attorney Sally J Elkington (Unclaimed Profile)
Bankruptcy lawyer at Elkington Law
It is never a good idea to reaffirm your mortgage and not required under the code, unlike vehicles. You should check with an attorney regarding your state's foreclosure laws and your liability. In California, most, if not all 1st mortgages are non-recourse and the mortgage company cannot pursue a deficiency. Junior mortgages can be a little more complex depending on when you got them and what you did with the money. You cannot report your own payment status to a credit agency fur obvious reasons. Call your mortgage company and find out why they aren't reporting your payments.
