If co-owned property is part of a bankruptcy it can be claimed exempt within certain limits. If their is non-exempt property it can be sold by the chapter 7 trustee.? The co-owner must be paid their share or else the property will not be sold.

I filed for bankruptcy but am still haing financial problems, what can I do?

Maureen O'Malley

You can give up the house without penalty if you choose. Stay there but don't pay the mortgage. They'll eventually foreclose (may take a year or more) and you'll have to leave once it sells. But you'll owe nothing more. You'll have to pay HOA dues if you have them, and keep it insured. You may also have to pay property taxes unless those become due bt the foreclosure buyer. As to your truck, you'll have to keep it up to date if you want to keep it. You may find a friend or relative willing to give away or sell something cheap to keep you going until you're back on your feet.

How do I stop the defendant from filing for bankruptcy to cancel the judgement?

default-avatar
Answered by attorney Asaph Orion Abrams (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Asaph Abrams
There are strict exceptions to discharge of debt under Title 11 of the United States Code. Bankruptcy is a federal legal procedure: within the context of the filed bankruptcy case, a creditor may object to the dischargeability of a particular debt IF there is a legitimate, relevant, and supported basis, such as fraud-the fact that there's already a judgment in hand does not per se grant extra protection to the creditor. A judgment can be voided by the bankruptcy. The creditor CANNOT block the debtor from filing bankruptcy. This answer (as well as our Web site) doesn't address all facts & implications of the question; it's general info, not legal advice to be relied upon; it creates no attorney-client relationship; it may be pertinent to CA only; it's independent of other answers. Hire legal counsel before acting or refraining from bankruptcy/legal action.
