Can I file for Bankruptcy if I have only past due mortgage payments as my main debt?

Answered by attorney Loren Paul Zahn (Unclaimed Profile)
Bankruptcy lawyer at Zahn Law Office
You can file for bankruptcy protection with only one debt, but if you cannot make the payments on the home, then a chapter 7 will only delay the foreclosure on your home. A chapter 13 may allow you to reduce your payments, but there are no guarantees.

Will quitting job affect our filing for bankruptcy?

Discuss this with your attorney, if you are going to do this it could have ramifications because it will reduce the household "income". If you do not have counsel, engage one.

Should I file Chapter 7 Bankruptcy if I'm being harassed by payday loan for loans I can't afford to pay?

Bankruptcy is a constitutional choice. "Can you file" - most likely. The important question is really "should you file"?
