What can I do with a collection agency?

default-avatar
Answered by attorney Kevin W. Bruning (Unclaimed Profile)
Bankruptcy lawyer at Bruning & Associates, P.C.
You should send a letter to the collections agency at their address on whatever collection notices they are sending to you. Tell them in the letter that you dispute the debt and that you are demanding proof that you owe the debt. They have to provide that proof to you if you request it, and then you can dispute with them that you owe it.

Do I have to apply for a home loan modification with my spouse?

Mark Stuart Cherry
Answered by attorney Mark Stuart Cherry (Unclaimed Profile)
Bankruptcy lawyer at Mark S. Cherry, Attorney at Law, PC
You are not obligated to participate in a modification and you are not liable for any deficiency (balance due) judgment unless you signed a reaffirmation agreement during the bankruptcy(ies). You should check with your bankruptcy attorney to find out if you reaffirmed the mortgage note.
