I just went through a divorce when can I file a chapter 7?

Katharine Renee Granger
Answered by attorney Katharine Renee Granger (Unclaimed Profile)
Bankruptcy lawyer at Granger Law Firm LLC
You can file for bankruptcy now that the divorce is final. You should meet with an attorney to make sure you meet the qualifications for Chapter 7 and that you are not in danger of losing any assets.

Is unsecure creditor is entitled to paid if the company recover form financial distress?

default-avatar
Answered by attorney Steven Jed Alpers (Unclaimed Profile)
Bankruptcy lawyer at Steven J. Alpers, A Professional Corporation
This is not really a bankruptcy question, but may be a contract question. Before a company is to be wound up, the question is what the loan said. If the loan agreement said repay Angel first, then it is a debt of the corporation. If the loan papers said she was entitled to recover from the other share holders she would have a right to recover from them.

Will stripped liens be taken off my record after a Chapter 7?

default-avatar
Answered by attorney Spencer Thomas Hale (Unclaimed Profile)
Bankruptcy lawyer at San Tan Family Law
If you get an order to strip a lien in a chapter 13, the actual release of the lien will not occur until/unless you complete the chapter 13 plan. Therefore, if you convert to a 7 then the lien still exists.
