There is no requirement that expenses exceed income to file chapter 7. You should also explore chapter 13 to possibly strip the second mortgage.? Consult with a bankruptcy attorney.

It is possible to sue but you need to list the cause of action as an asset on Schedule B. Unless you can exempt it on Schedule C, the Trustee, not you, will have the right to pursue the claim & collect any award.

The main purposes of bankruptcy is to avoid having your creditors seize your property and to avoid having creditors seize your income.After 10 years on SS disability, do you have any assets of value?SS disability is exempt from attachment by your creditors.Unless you have valuable assets, all filing bankruptcy will do is stop your collection calls. Unless you're a nervous person, I wouldn't bother filing bankruptcy?
