Can I keep my house and file chapter 7?

Maureen O'Malley
Answered by attorney Maureen O'Malley (Unclaimed Profile)
Bankruptcy lawyer at Maureen O'Malley
If you have that much equity the trustee will probably want to sell. If you can find a Ch 13 that will pay off the late payments you could keep the house.

Would we lose all of these things when we file for bankruptcy?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
You have to pay for your house and your car in order to keep them after filing bankruptcy. State laws called exemptions will protect many other assets you own from the bankruptcy court, but you must apply for this protection in your bankruptcy paperwork which is one reason why retaining an experienced bankruptcy attorney is so very important.

If I file bankruptcy, does it take away my court fines that are in collections and hospital bills?

Answered by attorney Paul D Stuber
Bankruptcy lawyer at Law Office of Paul Stuber
It depends. Most debts are dischargeable. Medical bills almost for sure are gone but court fines are most likely not. Talk to your attorney about the specific debts.
