Do you have to file bankruptcy in the state you live in?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
If you have resided and your primary assets were located in Truckee for at least 91 days prior to the filing date of your bankruptcy, then your case would need to be filed in Sacramento. In order to file in Nevada, you would need to move there or have your principal assets located there for at least 91 days prior to filing your case.

If I go bankrupt because of students loans, will I lose my car that I am making payments on?

Answered by attorney Max L Rosenberg
Bankruptcy lawyer at Rosenberg Hite, LLC
First, you cannot discharge student loans in a Chapter 7 bankruptcy. It would be foolish to file a Chapter 7 bankruptcy to try and remove student loans. There used to be certain loopholes. They no longer exist. The only way to get out of student loans is if you have a severe in extreme hardship. This threshold is almost impossible to reach. If you are trying to keep your car you can file a reaffirmation agreement. if you hire an attorney with experience in bankruptcy law they will tell you all of this. If you try to file without an attorney you are very foolish.

I filed bankruptcy after I went and got a payday loan the company is talking about garnishing my wages can they?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Bankruptcy lawyer at Richard B. Jacobson Associates, LLC
If the loan was made after you filed bankruptcy, it cannot be discharged in your bankruptcy, and the loan company can sue you. They would be wise to wait until you get your discharge, but it is actually not required if you are now in a Chapter 7. Check with your lawyer. If you don't have one, it would be a good idea to hire one.
