How and when will I recieve a refund of garnished wages after filing for chapter 7 bankruptcy?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
That depends on when they were garnished.  Were they garnished before you filed bankruptcy, or after?  If before, you probably won't get them back.  If after, you'll usually get them back after your discharge is entered, and possibly sooner if your attorney properly informs the sheriff's department and the creditor.   Mark Markus has been practicing exclusively bankruptcy law in California since 1991.  He is a Certified Specialist in Bankruptcy Law by the State Bar of California Board of Legal Specialization,  AV-Rated by martindale.com, and A+ rated by the Better Business Bureau.  CONTACT MARK for more information or to schedule an appointment.

What kind of answer do I file?

Answered by attorney Michael D. Siegel
Bankruptcy lawyer at Siegel & Siegel, P.C.
An answer to the original complaint.  You did not get the case dismissed.  Just the judgment.  You are now at square one, as if you were served now.

If I file for chapter 7 bankruptcy and my son gets survivor benefits will this affect him being his debit card is in my name?

Diane L Drain
Answered by attorney Diane L Drain (Unclaimed Profile)
Bankruptcy lawyer at Law Office of D. L. Drain, P.A.
Normally not, but it is included as "income" to the family. Please understand that filing for bankruptcy is a very complicated process. It is wise to talk to an experienced bankruptcy attorney before deciding to take this important step. Most Arizona bankruptcy attorneys offer a free consultation about the basics of bankruptcy.
