What can I do if I can't afford chapter 13 payment and my attorney won't help?

Charles J Schneider
Answered by attorney Charles J Schneider (Unclaimed Profile)
Bankruptcy lawyer at Charles J. Schneider, P.C.
Sometimes an amount has to be paid in a chapter 13 case whether one can afford it or not to reach a goal that the client wants. Sometimes attorneys who receive a flat rate and do not charge by the hour will not respond to client phone calls as they do not make any more money for doing so. Sometimes attorneys do not wish to take over another attorney's case because the attorney that they replace may have messed the case up badly and there will be disgruntled clients that have lost their faith in attorneys in general and therefore will be difficult.

If a co defendant has received a bankruptcy stay in our case, can I still get a fair trial without him?

Answered by attorney John F Brennan (Unclaimed Profile)
Bankruptcy lawyer at Musilli Brennan Associates, PLLC
I would speak either attorney but it certainly appears that he is an indispensable party, and additionally the creditor should be seeking a determination on the discharge ability of his debt if it was incurred as a result of a fraud. Generally, fraudulently incurred debts are not dischargeable.

How do I get a bankruptcy off of my credit report?

Pamela L. Stewart
Answered by attorney Pamela L. Stewart (Unclaimed Profile)
Bankruptcy lawyer at Pamela L. Stewart, Attorney at Law
Unfortunately, you can't get the bankruptcy off your credit report. By law, credit reporting agencies have the right to report a bankruptcy for ten years from the date the case was filed. The bankruptcy is a part of your credit history - you don't dispute the fact that you filed for bankruptcy. Two years after bankruptcy is a very short time to expect to be obtaining credit and loans - especially considering where the economy is. Even if your credit was just okay, I doubt you would be able to get a mortgage loan at this point. Give it time, as your bankruptcy ages, it will have less weight on your credit score. Meanwhile, you should pay on time for whatever debt, bills you may have.
