You need to set up a consultation with a few attorneys. Most creditors back off when someone files a bankruptcy, otherwise they may violate the federal automatic stay. You cannot do anything to try to collect the debt. If it was a fraud on you or a larceny, the debt may not be dischargeable, but only an attorney will be able to tell you that and do anything about it. You may just have to claim the amount as a loss on your income tax return. Consult with an attorney asap.

Your question is confusing. Did the company officer commit bankruptcy fraud? If so, disclose that to the US Trustee's Office. Or, did you question mean that there was fraud committed by the company's officer and now you are considering filing for bankruptcy. Therefore, you are asking if you can pursue this fraud issue in bankruptcy. If that is the question then the answer is yes. But, you need to get competent advice about the consequences of filing for bankruptcy.

You are up against a very difficult problem. You have to keep at it until you get to a sympathetic supervisor. Without a lawyer it will be very difficult. Most lawyers will charge you by the hour, and it will probably take 10-20 hours of attorney time to get their attention, prove the foreclosure was in 2009, and get them to send a correction to the credit scoring companies-and there's no guarantee that they can accomplish that. You may need to sue them for slander, which an attorney will charge another large round of attorney's fees for$5,000 just to prepare and file the lawsuit against Wells Fargo.
