Check your credit reports; if the loans are not shown as forgiven you need to dispute with credit bureaus in writing (copy to furnisher of information); if not corrected, sue under Fair Credit Reporting Act.

You should file your tax returns for 2007 and every other year too, if you have not already done so. You can file for bankruptcy, but the bankruptcy trustee may require you to complete your tax returns before ending your bankruptcy case. You should definitely contact an attorney who is experienced in handling bankruptcy matters.

Make sure that you talk to an attorney about the document. It is possible that the deed in lieu has a provision that you will pay a certain amount of debt. Depending on where your property is located it might be better to let them foreclose.
