After you file your petition, your personal liability for the assessments due as of that date will be discharged. However, if the HOA has a lien on the property, that lien will most likely remain on the property. Additionally, you will be liable for all assessments accrued after the date of filing, as long as you are on title.

Should I file for bankruptcy if I cannot pay attorney fees? How?

If you had been drinking, you cannot discharge damages for personal injury. Ordinarily you can discharge legal fees, but there are exceptions. It is perfectly lawful to represent yourself in a bankruptcy, but it is rarely a good idea. It's almost always best to retain an experienced lawyer. Some lawyers will accept instrumental payments. Good Luck.

Bankruptcy sounds like a good option for you, I would recommend that you put the trailer on the 5 acres you own and move into it before you file the bankruptcy. That way, the trailer and five acres are covered by your homestead exemption?
