Most attorneys require (or should require) 100% payment before filing because they become creditors after filing (specifically speaking about consumer chapter 7). There are two avenues you may want to pursue: 1. Defend the foreclosure and attempt a loan modification in the context of court-ordered mediation or 2. File Chapter 13 bankruptcy yourself and, in the meantime, work with a HUD-certified agency on a workout.

Your attorney is correct, not because all contracts must be in writing, but because you have no proof that you really lent her the money. Also, most states have a statute of limitations on suing people to collect a loan, and it is typically MUCH less than 20 years - here in California, it's 4 years.
