Do I need to provide all these information about my car and insurance that are both in my name only if my husband is filing chapter 7?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
Your husband is telling the truth. It is still seen as a household, ?that is the reason for the paystubs. Trustee can and has right to inquire into the cars in the household and such. I would give the info asap.

Can or should I seek legal help to clear up debts that should in theory be falling away from my credit report and dropped by collectors?

Charles J Schneider
Answered by attorney Charles J Schneider (Unclaimed Profile)
Bankruptcy lawyer at Charles J. Schneider, P.C.
You have a bad theory neither credit reports nor credit reporting agencies determine whether a debt is owed. You still owe the debt whether it has been "charged off" on a credit report. It does not mean they will not choose to enforce nor does it mean that they will not sell the debt to a third party who will choose to enforce it. Judgments in the State of Michigan remain so for 10 years and then may be renewed for another 10 years.

If I am already under chapter 13 bankruptcy, can I get a garnishment now?

Answered by attorney Stuart M. Nachbar
Bankruptcy lawyer at Law Office of Stuart M. Nachbar, P.C.
If YOU are in the Bankruptcy, and it is a Chapter 13, then no they can not do a Wage Garnishment without permission of the Bankruptcy Court. It is a violation of the automatic stay as well as the fact that if effects disposable income which is paid to the Chapter 13 Plan. Talk to your counsel.
