What do i do if the owner has court to lift the stay for eviction

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
Depending on the basis for the Motion you need to file an opposition to the Motion For Relief From Stay or negotiate with the creditor to resolve the Motion (usually by having an adequate protection order entered).  What options you have depends on the specific facts of your case, how your plan is structured, and other considerations.  If you don't have an attorney, you should hire one  immediately to represent you.

Does the trustee check and verify bank statements with your bank for actual amount?

You have waived confidentiality by filing bankruptcy and giving the trustee a copy of these documents under penalty of perjury. In my experience,if an attorney files your bankruptcy, trustees seldom verify the bank account information. They're more likely to verify IRS information. If you're considering giving fraudulent information to the trustee, I strongly advise against it. You're filing bankruptcy because you have financial problems; bankruptcy fraud will give you a criminal problem. If you think that your problems are bad now, wait until you have a felony conviction.

Tell them you have no legal obligation to pay the bill and won't pay it and ignore them and they will go away eventually.
