Can the bank take my car if I file for bankruptcy?

No. You are entitled to keep one car per person in bankruptcy. However, if you are making car payments you will need to continue to make them.

When filing a Chapter 7 bankruptcy schedule J, if your monthly debt exceeds your monthly income, what happens?

I am afraid your question cannot be answered without more information. As a rule, people who can pay all their monthly expenses do not file for bankruptcy. However, you really need to talk to your attorney to see if your situation will be a problem.

Where do I find information on Chapter 7 and 13?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Bankruptcy information is all over the internet. If you would like to watch videos, I and many other attorneys explain bankruptcy on Youtube. Bankruptcy is a vast and complex area of the law and attorneys and judges can disagree as to how the law is interpreted. Don't expect to learn about bankruptcy through research, nothing beats an in person consultation with an experienced attorney.
