If there is no proof of ownership by either party, you just need to indicate it that way on the schedules. It would also be best to exempt your husband's interest to keep it from being liquidated by a trustee.

You can move out without an eviction order, but once your bankruptcy is dismissed, the landlord can reinstate any existing order of eviction just as if you had never filed bankruptcy or may chose to refile for an eviction.

Most trustees require a copy of bank statements that cover the period before and after the bankruptcy filing. You are required to submit a tax return for the last period during which a return was due (2013). Some trustees require more than one prior tax return. You should redact all but the last four digits of your social security number when submitting tax returns.
